Terms of Service

1. Acceptance of Terms

By accessing or using the KlindrOS Marketing Intelligence Operating System (the "Service"), including the web application and mobile application, you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Description of Service

KlindrOS is an enterprise marketing intelligence platform that provides analytics, campaign management, customer data platform (CDP), competitive intelligence, creative optimization, and AI-powered insights. The Service includes 10 integrated modules: KScore, Workflow & RBAC, Listening & CI, Media Command, Creative Command, Social Management, SEO & Content, CDP, MarTech Integrations, and Executive Dashboard.

3. Account Registration

To use the Service, you must:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Promptly notify us of any unauthorized access to your account
• Accept responsibility for all activities that occur under your account

You must be at least 18 years old to create an account. Each user must have a unique account; sharing login credentials is prohibited.

4. Permitted Use

You agree to use the Service only for lawful business purposes. You may not:

• Reverse engineer, decompile, or disassemble any part of the Service
• Use the Service to process data in violation of applicable data protection laws
• Attempt to gain unauthorized access to other users' data or accounts
• Use automated tools to scrape, crawl, or extract data from the Service
• Resell, sublicense, or distribute the Service without prior written consent
• Upload malicious code, viruses, or harmful content
• Interfere with or disrupt the integrity or performance of the Service

5. Data Ownership

You retain ownership of all data you upload to or create within the Service ("Your Data"). By using the Service, you grant KlindrOS a limited, non-exclusive license to process Your Data solely for the purpose of providing and improving the Service. We do not claim ownership of Your Data and will not use it for purposes other than delivering the Service.

Upon termination of your account, you may request export of Your Data in a machine-readable format. We will retain Your Data for 30 days after account termination before permanent deletion.

6. Multi-Tenant Isolation

KlindrOS operates as a multi-tenant platform. Each organization's data is logically isolated using organization-level access controls. We implement role-based access control (RBAC) with five permission levels: Super Admin, Admin, Manager, Approver, and User. Data from one organization is never accessible to another organization.

7. Third-Party Integrations

The Service allows integration with third-party platforms including Meta, Google, TikTok, LinkedIn, YouTube, and others. Your use of these integrations is subject to the respective third-party terms of service and privacy policies. KlindrOS is not responsible for the availability, accuracy, or policies of third-party services.

8. AI-Powered Features

The Service includes AI-powered features such as content generation, sentiment analysis, predictive scoring, and conversational assistance. AI-generated outputs are provided as suggestions and should be reviewed before use. KlindrOS does not guarantee the accuracy, completeness, or suitability of AI-generated content for any specific purpose.

9. Service Availability

We strive to maintain 99.9% uptime for the Service. However, we do not guarantee uninterrupted access. Scheduled maintenance will be communicated in advance when possible. We are not liable for any interruptions caused by circumstances beyond our reasonable control.

10. Limitation of Liability

To the maximum extent permitted by applicable law, KlindrOS shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service.

11. Termination

Either party may terminate the use of the Service at any time. We reserve the right to suspend or terminate your account if you violate these Terms. Upon termination, your right to use the Service ceases immediately, and you may request export of Your Data within 30 days.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Indonesia, without regard to its conflict of laws principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Indonesia.
